The States and Territories in Australia regularly offer nominations to skilled individuals for their immigration to Australia for work. The nominations are provided through the Skilled Nominated Visa (Subclass 190). This is an invites-only Australia Visa Program. Successful candidates are permitted to permanently live in Australia for pursuing study, work, and other endeavors.

Australia Skilled Nominated Visa Subclass 190 is a points-based Australia PR Visa. The interested candidates must first submit an EOI - Expression of Interest to the Home Affairs Department of Australia.

The Skill Select portal of DHA accepts the submissions of EOI throughout the financial year in Australia. You are offered points based on the submission. The candidates who secure the highest-ranking EOI are offered the ITA - Invitation to Apply for the Skilled Nominated Subclass 190 Visa.

How to Get the Skilled Nominated Subclass 190 Visa?

If you wish to obtain the Skilled Nominated Subclass 190 Visa to reside, study and work in Australia, you must note the following essential points:

  • You are required to first submit an EOI for a State or Territory in Australia for assessing your unique attributes and abilities.

What Skills Assessments are required for Subclass 190 Visa?

The Skilled Nominated Subclass 190 Visa requires you to undergo appropriate skills assessment while submitting the EOI. The assessment must be independently obtained from a designated assessing authority.

Each occupation is assigned a suitable assessing authority. You are required to contact the appropriate authority and get a true assessment of skills before submitting the Visa application.

Conditions for Skilled Nominated Subclass 190 Visa

You can apply only if you receive the ITA. To be invited, you are required to:

  • Possess experience in a nominated occupation present on Australia's SOL - Skilled Occupations List
  • Obtain assessment for skills from an appropriate assessing authority for the occupation
  • Submit the EOI - Expression of Interest
  • Be aged above 18 years and below 45 years when you receive the ITA
  • Fulfill the basic requirements for skilled immigration inclusive of Character, Health, and English language
  • Be able to secure a minimum of 65 points on the Australia 65 Points Calculator
  • Reside permanently in Australia
  • Study and work in Australia
  • Enroll in Medicare - The public healthcare scheme in Australia
  • Sponsor your relatives to immigrate to Australia
  • Travel to Australia and from Australia for five years
  • Become a Citizen of Australia if eligible

Freshly arrived Visa holders may be required to wait before accessing some payments and benefits from the Government of Australia.

How long can you stay?

Subclass 190 is an Australia PR Visa that permits you to stay indefinitely in Australia. It has a travel component that has an expiry after 5 years from the date of approval of the Visa.

You obtain the status of Permanent Resident in Australia from the date of approval of the Visa. For purposes of citizenship, your PR status begins on the day:

  • Of approval of the Visa by DHA if you are within Australia
  • Of your entry to Australia through this Visa if you are overseas

You are allowed to include your family members in your Subclass 190 Visa application. You can:

  • Take in the family members at the time of lodging your visa application
  • Add the family members after filing the Visa application but before the declaration of verdict for your Visa

Family members who are included in the Visa application must fulfill the Character and Health requirements. Non-accompanying family members may also need to fulfill the Character and Health requirements.

If you do not include your partner or dependent kids in the Visa application, you must inform DHA of the reason for doing so for assisting in the processing of your application.

Travel

You are authorized to travel from overseas to Australia and from Australia to overseas multiple times for five years from the Visa approval date. You will require an RRV - Resident Return Visa: Subclass 57 or 155 after 5 years for re-entry into Australia as a Permanent Resident. You need to be in a position to fulfill the points score requirement specified in your Letter of Invitation. It will be 65 or higher points. The score is based on the details submitted in your EOI. You must be able to meet the eligibility for points score at the time of receiving the ITA for the Visa.

Eligibility Requirements for Skilled Nominated Subclass 190 Visa

You can apply for a Subclass 190 Visa only if you receive an ITA from DHA. For this, you must submit an EOI to inform the DHA regarding your interest to apply for this Visa. You can be nominated by a State or Territory Government in Australia after submitting the EOI.

You must receive a nomination from the State or Territory Government in Australia for this Visa. For this, you will need to file an EOI in Skill Select portal. These government agencies can view your EOI and nominate you for the Visa.

You must receive an Invitation to Apply from DHA if you are nominated. The following are the various State and Territorial Governments whose agencies have specific criteria to decide for nomination.

  • New South Wales
  • Australian Capital Territory
  • Queensland
  • Northern Territory
  • South Australia
  • Victoria
  • Tasmania
  • Western Australia

Your application becomes invalid if your nomination is withdrawn by the State or Territorial agency after you apply.

Your Visa application will be valid only if you declare that you have obtained a suitable assessment of skills at the time of receiving ITA. A copy of the skills assessment must be provided at the time of filing your application.

The following are also accepted as evidence of skills assessment for legal and medical practitioners:

  • General or unconditional or full medical registration with the Health Practitioner Regulation Agency in Australia
  • Provisional specialist registration with the Health Practitioner Regulation Agency in Australia. It only permits you for practicing in your specialty and you require no further supervision or training.
  • Admission for practicing Law in the relevant Territory or State

You must have obtained the skills assessment in the past 3 years before the date of receiving the ITA. If the assessment obtained was for a shorter period, then that period must not have lapsed.

Your age has to be less than 45 years when you receive the ITA for the Subclass 190 Visa. You are still eligible to submit the Visa application if you attain the age of 45 years after you receive the ITA.

If you attain the age of 45 years after submission of EOI but before receiving the ITA, then you will not receive the invitation to apply.

The Skilled Nominated Subclass Visa 190 is Australia PR Visa based on points. After you submit the EOI in Skill Select portal, you will be awarded points bad on the claims you make in it. You will not receive the ITA for this Visa if you cannot secure a minimum of 65 points.

If the DHA offers you the ITA, it will specify the number of points that you need to score on the invitation when it assesses your Visa application for approval. Depending on the claims made in your EOI, this score can be greater than 65 points.

  • You must have minimum competent level proficiency in English at the time of receiving the ITA.
  • Your occupation must be present on the appropriate list of qualified skilled occupations for the Subclass 190 Visa.
  • You and accompanying family members for this Visa if any must fulfill the specified health requirements. Non-accompanying family members to Australia may also have to fulfill the requirement if so requested.
  • You and accompanying family members above 16 years for this Visa if any must fulfill the specified character requirements. Non-accompanying family members to Australia also have to fulfill this requirement.
  • You and your accompanying and non-accompanying family members for this Visa must pay back or arrange payment of the debt to the Australian government if any such debt exists.

If you are 18 years old or higher, you are required to:

  • Have read or get explained to you the "Life in Australia"
  • Endorse that you will honor the way of life in Australia and obey the laws in Australia by signing the Values statement of Australia

You may not remain eligible for a Skilled Nominated Subclass 190 Visa if any of your earlier Australian Visa was canceled or rejected during your stay in Australia.

You can apply for the Subclass 190 Visa from outside Australia and remain overseas even at the time of decision on your Visa. This does not apply to immigration clearance, however.

If you apply from within Australia, you must hold any of the following Visas failing which your application becomes invalid:

  • Subclass 030 Bridging C Visa
